SPOUSAL MAINTENANCE 101

Fourteen years on the job may not be enough time to retire on, but Arizona, it may be enough time for Arizona courts to consider if a spouse is entitled to an award of spousal maintenance. But in some cases there are exceptions to this rule, and a spouse may not have to wait so long to receive an award of spousal maintenance.

In addition to duration of the marriage the court will also consider these matters:

1. Lacks sufficient property, including property apportioned to the spouse, to provide for that spouse's reasonable needs.

2. Is unable to be self-sufficient through appropriate employment or is the custodian of a child whose age or condition is such that the custodian should not be required to seek employment outside the home or lacks earning ability in the labor market adequate to be self-sufficient.

3. Contributed to the educational opportunities of the other spouse.


The matter of whether a requesting spouse will be awarded spousal maintenance award is extremely complex and should be trusted to amateurs.
